Reaction Roundup: Supreme Court Upholds Partial Birth Ban

John on April 18, 2007 at 10:01 am

The Supreme Court upholds the ban on partial birth abortion in a 5-4 decision. Here’s Ed Whelan at NRO:

On initial read, this opinion strikes me as a significant victory. In particular, it appears that the Court is disinclined to continue to have special ad hoc rules that uniquely favor those who challenge abortion regulations.

Professor Glenn Reynolds is disappointed:

I believe that the ban should have been struck down on commerce clause grounds as outside Congress’s power to regulate interstate commerce.

Allahpundit at Hot Air has a great line:

Anthony Kennedy wrote the majority opinion? This is like Darth Vader throwing the Emperor down the well at the end of ROTJ.

Planned Parenthood’s mouthpiece is in high dudgeon:

This ruling flies in the face of 30 years of Supreme Court precedent and the best interest of women’s health and safety. … This ruling tells women that politicians, not doctors, will make their health care decisions for them.

Yes, what has the world come to when only four members of the court support sucking an infants brains out and crushing its skull. It’s outrageous! Also good for fund raising I bet.
